If the brain or body are not mature at the age of 18 then the definition of an adult is not attached to maturity or development but to existence and expectation.

It is wholly unfair to determine the level of one's intellect based on the time of existence rather than it's actual capability.

In that same vein, every individual matures differently and it might be in the best interest of the offender if they are given an evaluation to determine their capacity and then they can be appropriately charged for a crime.
