Article 2, of the Articles of the Confederation, states that "each state retains it's sovereignty, freedom, and independence and every power..." If any amendment was necessary, it needed the approval of the states. The Articles were ratified in 1781. They installed a national government with strong states that could levy taxes, not Congress.
