Based on fifth amendment privilege from self-incrimination, police must take appropriate safeguards to ensure that a defendant's rights are not violated during arrest. Specifically, police must advise defendants that they have the right to remain silent, any statement made may be used against the defendant in court, the defendant has the right to have an attorney present during questioning, and if a defendant cannot afford an attorney, then the state will appoint one prior to questioning.
